All Members/Guest(s) are required to sign the Rental Agreement that is sent via email when a reservation is created. Failure to sign the agreement prior to check in does not absolve the Member/Guest(s) from its binding terms. Once the Member/Guest(s) has checked in by entering the property listed on their reservation during the reservation period, they are bound to the terms of the Rental Agreement.

By placing a reservation at any of the Cottages at Champions, or the Olde Clubhouse, you are accepting the Rental Agreement detailed below as well as the rules of the Cottages and Champions Golf Club.

Champions Golf Club, Inc. (“Champions”) enters into this Rental Agreement for the Cottages at Champions with Member/Guest(s) upon the following terms and conditions.

1. FACILITIES: The Cottages at Champions are located directly across from the main entrance of Champions Golf Club in the Champions Colony West subdivision. Available units include cottages 1,2,4,5, and 6. The Olde Clubhouse is located at Champions Golf Club, 13722 Champions Drive, Houston, Texas. All amenities available to the cottages are offered or supported at the Clubhouse.

2. DAMAGES: The Member/Guest(s) are financially responsible for all damages that are beyond normal wear that occur during the reservation period. By accepting this agreement, the Member/Guest(s) authorizes Champions to charge the card on file for all costs associated with the repairs of any damages that occurred during the Member/Guest(s) reservation. An inspection by the staff of Champions will occur within 24 hours of the rental to determine any possible damage. In the event of damages and/or policy violations that occur during a rental period, a minimum of $250 will be charged to the credit card on file and a maximum amount equal to the cost of the damages plus $250 will be charged. If deposit and damages cannot be recouped through the card on file, the deposit, damages, and any associated fees will be billed to the applicable Champions Golf Club member account, reciprocal club member account, or sent to collections. Champions reserves the right to pursue all legal remedies in order to recover the damages caused by the Member/Guest(s).

3. INCIDENTALS: Any incidental charges incurred by Member/Guest(s) during the reservation period will be charged to the credit card on file once the reservation has ended. By accepting this agreement, the Member/Guest(s) authorize Champions to make an additional charge for incidentals that may include but are not limited to cart fees, green fees, food & beverage consumed in the clubhouse or locker rooms, and optional items within the cottages.

4. CANCELLATIONS/REFUNDS: When reservations are made at the cottages, 50% of the reservations total is charged immediately. In the event of a late cancellation, $250 will be deducted as the security deposit from the initial payment that was made at reservation creation. Cancellations must be received in writing. Generally, if notice of cancellation is received at least three days before the date of rental, Member/Guest(s) will receive a full refund; if the cancellation notice is received less than three days prior to the date of rental, the entire security deposit will be forfeited. If, however, rental occurs during or over a state or federally sanctioned holiday, or during the time of a tournament at Champions, notice of cancellation must be received at least three weeks before the date of rental or the entire security deposit will be forfeited.

5. USE OF TOBACCO PRODUCTS: Smoking (including vaping) and use of tobacco products are not permitted in the cottages and any violation of this policy will result in an additional $250 charge for policy violation and associated cleaning cost. Depending on the severity of the situation, it may result in Member/Guest(s) being asked to leave the facilities.

6. USE OF PREMISES: Any cottage rental may be utilized for residential purposes only. Member/Guest(s) are not authorized to sell products or services or conduct any commercial activity.

7. ILLEGAL ACTIVITY: Member/Guest(s) shall use cottage rentals for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.

8. FOOD/CATERING: Member/Guest(s) may bring food to the facilities from outside restaurants or establishments for personal consumption. Having food delivered or catered by outside restaurants or establishments is allowed except for food trucks/trailers. Member/Guest(s) have full dining privileges in the Clubhouse and all other Club facilities. (Must be accompanied by Member sponsor.)

9. PETS: No pets are allowed in the cottages. If Champions discovers or finds evidence that a pet has been on the property during Member/Guest(s) stay, Champions will charge the card on file or member account $250 for policy violation and associated cleaning costs. If the Member/Guest(s) is occupying the property at the time the pet is discovered, they will be asked to remove the pet immediately. If the Member/Guest(s) elects to leave the facilities with the pet, no refunds of rent or fees will be given. Notwithstanding the above, animals that assist persons with disabilities or who require special assistance (i.e. seeing eye dog) will be allowed at the facilities as long as this is made known to Champions prior to the rental date and does not cause an undue hardship or damage to Champions or the cottages.

10. INSPECTION: Champions has the right to inspect cottages with prior notice as in accordance with State law. Should the Member/Guest(s) violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Member/Guest(s) waives all rights to due process if they fail to vacate the premises upon termination of the rental period.

11. MAINTENANCE AND REPAIRS: The Member/Guest(s) shall maintain any applicable cottage rental in a good, clean, and “ready-to-rent” condition which is defined by Champions as being immediately habitable by the next Guest. The Member/Guest(s) shall vacate the applicable cottage rental at the expiration of this Agreement. The Member/Guest(s) shall pay for maintenance and repairs should the applicable cottage be left in a lesser condition. The Member/Guest(s) agrees that Champions shall charge the card on file or member account for the costs incurred to return the property to the state that it was in prior to the applicable rental period.

12. TRASH: The Member/Guest(s) shall dispose of all waste material generated during the Rental Term under the strict instruction and direction of Champions.

13. QUIET ENJOYMENT: The Member/Guest(s), along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Member/Guest(s) are expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

14. GOLF FEES NOT INCLUDED: The rental fee does not include golf privileges at Champions nor any applicable fees for Member/Guest(s) (i.e. green fees, driving range usage, cart fees or merchandise).

15. SUBLETTING: Member/Guest(s) are prohibited from subletting any cottage rental to other businesses, guests, or individuals.

16. CONSUMPTION OF ALCOHOL AND WAIVER OF LIABILITY: Consumption of alcohol is permitted by Member/Guest(s) who are at least twenty-one (21) years of age. Persons under the age of twenty-one (21) shall not consume or possess alcohol on the premises of the facilities. Alcohol may be purchased from any beverage location at Champions Golf Club. Alcohol for authorized events held at the cottages must be purchased through Champions Golf Club. Any violation of this policy will result in a $250 policy violation charge and may result in the Member/Guest(s) being asked to leave the facility. Champions is not responsible or liable for personal or bodily injury or damage of any nature sustained by any person that is caused by, arises out of, or results in any way from the sale, use, possession, or consumption of alcohol.

17. INDEMNIFICATION/HOLD HARMLESS: Member/Guest(s) agrees to defend, indemnify and hold Champions harmless from and against any claims, demands, lawsuits, causes of action, liabilities, costs and expenses (including legal fees and court costs) arising out of any negligent, intentional, fraudulent or criminal acts or omissions relating to, or in connection with the rental of any of the cottages or the Member/Guest(s) use of the facilities and amenities (including the use by his or her guests), whether such claim, demand, lawsuit, cause of action, liability or cost or expense is caused by, a result of, or arises out of, in whole or in part, the sole, joint or concurrent negligence or gross negligence of Champions. The Member/Guest(s) expressly recognizes that any insurance for property damage or loss which Champions may maintain on property does not cover the personal property of the Member/Guest(s) and that Member/Guest(s) should purchase their own insurance if such coverage is desired.

18. GOLF CARTS: Member/Guest(s) are NOT permitted to operate Champions owned, leased, or rented golf carts on public roads, and as such, these carts are not authorized to be driven to or parked at the Cottages at Champions. Champions is not responsible or liable for personal or bodily injury or damage of any nature sustained by any person that is caused by, arises out of, or results in any way from improper operation or utilization of any golf cart whether it be owned by Champions or any other private entity regardless of the Member/Guest(s) being the driver or a passenger. In the event that Member/Guest(s) does not strictly adhere to this policy, the offending Member/Guest(s) will be bound by the INDEMNIFICATION/HOLD HARMLESS provision of this agreement.

19. POSSESSIONS: Any personal items or possessions that are left on the Premises are not the responsibility of the Champions. Champions shall make reasonable effort to return the item to the Member/Guest(s). If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, Champions shall be able to keep such items to sell or for personal use.

20. INTERNET USAGE: By using Champions provided internet service, you hereby expressly acknowledge and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the internet, whether the connection is facilitated through wired or wireless technology. Security issues include, without limitation, interception of transmissions, loss of data, and the introduction of viruses and other programs that can corrupt or damage your computer.

Accordingly, you agree that the owner and/or provider of this network is NOT liable for any interception or transmissions, computer worms or viruses, loss of data, file corruption, hacking or damage to your computer or other devices that result from the transmission or download of information or materials through the internet service provided.

Usage of our internet service to conduct or otherwise provide support for activities that violate federal, or state law will result in the Member/Guest(s) being asked to vacate the premises and the appropriate authorities being contacted.

21. PRIVACY: Though Champions Golf Club and the cottages owned and operated by the club are private property, the cottages are integrated within a public space. As such, no reasonable expectation of privacy can be guaranteed by Champions. Furthermore, Champions has 24 hr video surveillance throughout the club and the cottages. For the purpose of legal notice and relief from liability, it must be noted that at no point is the video surveillance actively monitored by an employee or service, and therefore, Champions cannot be held liable for failure to act upon any incident captured on video. It is also advised that any activities captured on video that are illegal in nature or otherwise not keeping with the standards of conduct expected by a member of Champions will be referred for appropriate action whether it be legal or punitive against the Member/Guest(s).

22. ACCESS TO PROPERTY: The rental of any cottage grants legal occupancy for the duration of the reserved time. Whether cottages are occupied or unoccupied, the staff at Champions Golf Club will enter the premises no less than once per day for the purpose of light cleaning, trash removal, and verification of adherence to policy by the Member/Guest(s). The responsibility and liability for the protection of personal property within the cottages rests solely with the Member/Guest(s). Champions has taken measures above the threshold of reasonable expectations to protect property at all times. Therefore, anything beyond those measures is the responsibility of the Member/Guest(s). It is recommended that the Member/Guest(s) keep valuables locked away at all times to ensure protection of personal property.

23. FORCE MAJEURE CLAUSE: The parties hereto are relieved of any liability if unable to meet the terms and conditions of this Agreement due to any "Act of God", riots, epidemics, strikes, or any act or order which is beyond the control of the party not in compliance; provided that the party claiming “Force Majeure” takes all reasonable steps practical and necessary to effect prompt resumption of its responsibilities hereunder.

24. ENFORCEABILITY/SEVERABILITY: In the event any provision of this Agreement is found to be unenforceable or invalid, such provision shall be severable from this Agreement and shall not affect the enforceability or validity of any other provision contained in this Agreement.

25. MEMBER/GUEST(S) ACKNOWLEDGEMENT: The Member/Guest(s) agrees to comply with all the laws of the State of Texas, Harris County and the City of Houston. The Member/Guest(s) further acknowledges that he/she has read and understands all the provisions contained in this Agreement and the payment terms set forth at the time the reservation was made and agrees to abide by all of its provisions.

26. GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas without regard to its choice of law principles. The venue for any legal dispute arising out of or relating to this Agreement shall be in the state courts of Harris County, Texas.
